Terms of Use: GreenNotes AI Data Processing Feature

By enabling and using GreenNotes AI features ("the Features"), you agree to these Terms of Use. These Terms govern your use of the AI-powered tools for medical data transcription, extraction, translation, summarization, and clinical support, and the processing of sensitive patient information.

1. Purpose and Functionality

GreenNotes uses artificial intelligence to process patient-related content including text, images, PDFs, videos, scanned notes, and audio files to:

  • Transcribe spoken notes
  • Extract structured clinical information
  • Summarize or translate records
  • Offer clinical documentation suggestions

The goal is to assist healthcare providers in improving the accuracy and efficiency of clinical documentation workflows. These Features do not replace medical judgment and human oversight should at all times be applied to the output of the Features.

2. Data Processing and International Transfer

Google Infrastructure

The Features use Google's secure, international cloud infrastructure. This may involve data transfers to servers located in countries outside of South Africa, such as the United States or members of the European Union.

Business Associate Agreement (BAA)

GreenNotes has concluded a BAA with Google to ensure that data is processed securely and in compliance with applicable laws, including HIPAA and POPIA.

3. User and Patient Consent

Patient Consent

You confirm and warrant that you have obtained express, voluntary, and informed consent from patients before submitting their information (including their personal information) for AI-based processing. It is your sole responsibility to ensure that patients are informed of, and understand, the purpose, scope, and destination of the data.

You hereby indemnify and hold GreenNotes harmless from and against any claims (including third-party claims) arising from your failure to obtain consent to the use of your data subjects' personal information with the Features.

Use Confirmation

By using the Features, you consent to the international processing, temporary storage, and analysis of data through GreenNotes AI systems.

Legal Responsibility

You are solely responsible for ensuring compliance with POPIA, the Health Professions Act, HPCSA rules, and any other applicable law or medical ethics code.

4. Data Subject Rights

Under POPIA, data subjects (patients) have the right to:

  • Access their personal information
  • Request the correction or deletion of personal information
  • Object to the processing of such personal information

Patients may exercise these rights through you as the healthcare provider, or via GreenNotes Support. Please visit our Privacy Notice and PAIA Manual for guidance on the process to follow to request access to, or the correction or deletion of, personal information.

5. Security and Retention

Encryption

All data is encrypted in transit and at rest using industry-standard protocols.

Google's Role

Under the BAA, Google acts solely as a data processor and does not retain or reuse data beyond processing needs.

Retention by GreenNotes

Files and structured data remain in your GreenNotes account for your records. You may delete them at any time.

6. Clinical Oversight

Extracted or transcribed data is provided "as is". You are responsible for reviewing, verifying, and approving outputs before using them in clinical care. GreenNotes AI tools are designed to support, not automate, clinical decisions.

7. Acceptance and Revocation

Explicit Consent

You must accept these Terms before using any GreenNotes AI-powered Feature. Your acceptance is logged for auditing purposes.

Revocation

You may disable AI features at any time. Previously processed data remains governed by these Terms and our Privacy Notice.
